Terms of Use

These Terms of Use (the “Terms”) govern access to and use of losaltosneurology.com and the public-facing webpages, articles, forms, features, and digital content made available through it (collectively, the “Site”) by Los Altos Neurology (“Los Altos Neurology,” the “Practice,” “we,” “us,” or “our”). Please read these Terms carefully.

Important: These Terms govern use of the Site. They do not govern the medical care provided by a clinician, do not replace informed consent, and do not waive or limit any duty or right that cannot lawfully be waived or limited.

1. Acceptance of These Terms

By accessing or using the Site, you acknowledge these Terms. When the Site presents these Terms in connection with a button, checkbox, account, form, comment, subscription, or other action, selecting that button, checking that box, or completing that action signifies your agreement to these Terms. If you do not agree, do not use the Site or the applicable feature.

You represent that you have legal capacity to accept these Terms. If you use the Site on behalf of an organization, you represent that you are authorized to bind that organization.

2. Related Policies and Separate Patient Agreements

These Terms incorporate our Medical Disclaimer and should be read with our Website Privacy Statement. When Los Altos Neurology handles protected health information as a healthcare provider, our Notice of Privacy Practices also applies.

Actual healthcare services may be governed by separate documents, including registration forms, consents for treatment, telehealth consent, financial policies, membership or concierge agreements, authorizations, and other patient agreements. Those documents govern the professional services to which they apply. If there is a conflict, the applicable patient agreement controls with respect to healthcare services, and these Terms control with respect to use of the Site.

3. Educational Information Only; No Medical Advice

The Site provides general educational information and general information about the Practice and its services. Site content does not constitute individualized medical advice, diagnosis, treatment, a medical opinion concerning any person, a recommendation for a particular medication, test, procedure, product, or clinician, or the informed-consent discussion required for medical care.

Do not use Site content to diagnose or treat a condition, determine whether you are eligible for a therapy, or start, stop, delay, or change medication, testing, or treatment. Consult a qualified healthcare professional who can evaluate your individual history, examination findings, records, preferences, and circumstances. See the Medical Disclaimer for additional information.

4. Not for Emergencies or Time-Sensitive Medical Matters

Do not use the Site, public contact forms, ordinary email, comments, newsletter functions, or appointment-request tools for a medical emergency or an urgent or time-sensitive medical concern. The Site is not monitored continuously and does not provide emergency services. In the United States, call 911 or go to the nearest emergency department when immediate care may be needed.

Do not assume that a message has been received, reviewed by a clinician, or acted upon unless Los Altos Neurology expressly confirms that it has.

5. No Physician–Patient Relationship Created by Site Use Alone

Viewing the Site, reading an article, subscribing to updates, posting a comment, sending an inquiry, joining a waitlist, requesting an appointment, or receiving an automated acknowledgment does not, by itself, create a physician–patient relationship with Los Altos Neurology or any clinician. Whether a physician–patient relationship exists depends on applicable law and the actual clinical relationship and cannot be established solely through public Site use.

If you are already an established patient, nothing in these Terms terminates or changes that relationship. However, public Site content is not individualized instruction for you. Use the communication method directed by your clinical team, such as the designated patient portal or office telephone number, for matters concerning your care.

6. Communications, Forms, and Appointment Requests

Except for a specifically designated secure patient portal, public-facing forms, ordinary email, comments, and newsletter features should not be treated as secure or appropriate channels for detailed medical information. Limit information submitted through public features to what is reasonably necessary. Do not send information about another person unless you are legally authorized to do so.

Electronic communications may be delayed, intercepted, misdirected, or accessed by unintended recipients. Although the Practice uses reasonable safeguards, no method of electronic transmission or storage can be guaranteed to be completely secure.

An appointment request is not an appointment and does not guarantee acceptance as a patient. An appointment is confirmed only when the Practice provides express confirmation. By providing contact information, you authorize the Practice or its service providers to respond to your inquiry using the contact method you supplied. This authorization does not constitute consent to marketing, automated calls or texts, or recurring promotional messages unless separate consent is requested and obtained.

7. Services, Eligibility, Costs, and Coverage

Descriptions of services are general and do not constitute an offer, guarantee, or promise that a service is available, clinically appropriate, covered by insurance, reimbursable, or suitable for a particular person. Clinical eligibility and treatment decisions are made individually by a licensed clinician after an appropriate evaluation.

Information regarding fees, insurance, reimbursement, scheduling, availability, or expected results may change and may be subject to separate written policies. Estimates and general descriptions on the Site are not binding quotations or guarantees of coverage. Concierge or membership services, clinical trials, telehealth, testing, infusions, procedures, and other specialized services may be subject to additional eligibility criteria and separate agreements.

8. Telehealth and Geographic Limitations

Information about telehealth does not itself initiate telehealth care. Telehealth services are provided only when permitted by applicable law, clinically appropriate, and supported by required registration and consent. Availability may depend on the patient’s physical location at the time of service, the clinician’s licensure, technology, and other factors.

The Site is operated from California and is primarily intended for users in the United States. Medical practices, product approvals, service availability, and legal requirements may differ by jurisdiction. Accessing the Site from another location does not represent that any service is lawfully or practically available there.

9. Accuracy, Currency, and Scope of Content

Los Altos Neurology makes reasonable efforts to provide medically grounded and current information. Medical knowledge, regulatory status, product labeling, clinical guidance, reimbursement, and standards of care change over time. Content may become incomplete or outdated after its stated publication or review date, may not address every relevant exception, and may not apply to an individual reader.

The Site is not a comprehensive medical reference and should not be relied upon as the sole source for a healthcare decision. Citations and links are provided when appropriate, but source materials may be revised, moved, or withdrawn. We may correct, revise, replace, or remove content at any time without notice.

10. Research, Medications, Devices, and Trade Names

Discussion of a medication, device, laboratory test, imaging test, procedure, clinical trial, investigational therapy, off-label use, manufacturer, or trade name is informational only and does not constitute endorsement, sponsorship, or a recommendation for any person. Regulatory status and availability may change. Preliminary, conference-reported, sponsor-reported, open-label, subgroup, biomarker, and externally controlled findings should not be treated as equivalent to confirmed clinical benefit.

All trademarks, service marks, and trade names are the property of their respective owners. Their appearance on the Site does not imply affiliation with or endorsement of Los Altos Neurology unless expressly stated.

11. Third-Party Websites, Platforms, and Services

The Site may link to or integrate third-party websites and services, including patient portals, scheduling or waitlist platforms, payment processors, maps, videos, laboratories, publications, social-media services, and other resources. Third parties are independent from the Practice and may have their own terms, privacy practices, accessibility standards, security measures, and content.

A link or integration is provided for convenience and does not necessarily imply endorsement. To the fullest extent permitted by law, Los Altos Neurology is not responsible for third-party content, availability, security, privacy practices, products, or services. Nothing in this paragraph limits duties that the Practice may have under HIPAA, California medical-privacy law, a business-associate agreement, or other applicable law.

12. Privacy

Our Website Privacy Statement describes the handling of information collected through the public Site. Our Notice of Privacy Practices describes uses and disclosures of protected health information when the Practice is acting as a healthcare provider subject to applicable health-privacy law. These documents serve different purposes.

You are responsible for using appropriate judgment when submitting information online. The presence of encryption or a privacy notice does not make every public Site feature an appropriate channel for clinical communication.

13. Age and Authorized Use

The public Site is intended for adults. A person under 18 should use the Site only with the involvement and permission of a parent or legal guardian. The Site is not directed to children under 13, and the Practice does not knowingly solicit personal information from children under 13 through public Site features.

14. Intellectual Property and Limited Permission to Use Content

Unless otherwise stated, the Site and its text, graphics, logos, photographs, videos, design, compilation, and other content are owned by or licensed to Los Altos Neurology and are protected by copyright, trademark, and other laws.

Subject to these Terms, you may access the Site and print or save a reasonable number of pages for your own personal, noncommercial, informational use. You may not reproduce, republish, distribute, sell, license, modify, create derivative works from, publicly display, frame, mirror, or commercially exploit Site content without prior written permission, except as permitted by applicable law. Copyright, attribution, trademark, and other proprietary notices must remain intact.

You may link to a public Site page if the link is lawful, does not imply sponsorship or endorsement, does not frame the Site, and does not misrepresent the linked content or your relationship with the Practice.

15. Automated Access, Scraping, and Artificial-Intelligence Training

Except for ordinary indexing by general-purpose search engines in accordance with our technical instructions, or as otherwise permitted by applicable law or written permission, you may not use a robot, spider, scraper, crawler, script, automated agent, data-mining tool, or similar process to access, copy, monitor, extract, aggregate, or republish Site content or data.

Without prior written permission, you may not use Site content to create or supply a dataset; train, fine-tune, test, benchmark, or improve a machine-learning or artificial-intelligence system; generate content at scale; develop a competing information service; or provide archived or cached collections to another person or entity.

16. Prohibited Conduct

You may not:

  • Use the Site for an unlawful, fraudulent, threatening, defamatory, harassing, infringing, or abusive purpose;
  • Impersonate another person, misrepresent your identity or authority, or submit false information;
  • Upload or transmit malware, harmful code, unsolicited advertising, spam, or content that interferes with the Site or another user;
  • Attempt to gain unauthorized access to accounts, systems, data, or security features, or conduct vulnerability testing without written authorization;
  • Collect personal information about other users or disclose another person’s confidential or health information without lawful authority;
  • Use Site content in a manner that falsely suggests that Los Altos Neurology has evaluated, endorsed, or provided medical advice to a third party; or
  • Remove or alter legal notices, attribution, technical restrictions, or security controls.

17. Comments and Other User Submissions

If the Site permits public comments or other public submissions, those features are not medical-care channels and should not be used to disclose personal health information. Public submissions may be visible to anyone. Do not post confidential information about yourself or another person.

You retain ownership of content you submit. For content intentionally submitted for public display, you grant the Practice a nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, format, and moderate that content as reasonably necessary to operate, secure, archive, and promote the Site and the associated discussion. This license does not apply to information submitted privately through a contact or patient-intake feature except to the extent needed to process the submission and comply with law.

You represent that you have the rights and permissions necessary to submit the content and that it does not violate law or another person’s rights. We may, but are not required to, review, edit, refuse, or remove a submission. User submissions express the views of their authors and are not medical advice or endorsements by the Practice.

18. Testimonials, Reviews, and Illustrative Content

Any testimonial, review, patient story, case example, or description of an experience reflects an individual experience and does not guarantee or predict another person’s outcome. Results and experiences vary. Models, stock photographs, illustrations, composite examples, or de-identified scenarios may be used for educational purposes and should not be understood as depicting a specific patient unless expressly stated.

19. Site Availability and Security

We may modify, suspend, restrict, or discontinue any part of the Site. We do not guarantee uninterrupted availability, compatibility with every device, freedom from harmful code, or preservation of information submitted through the Site. You are responsible for maintaining appropriate device security, backups, and internet access.

20. Disclaimer of Website Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, AND SOLELY WITH RESPECT TO THE SITE AND PUBLIC SITE CONTENT RATHER THAN PROFESSIONAL HEALTHCARE SERVICES, THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” LOS ALTOS NEUROLOGY DISCLAIMS EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, SECURITY, AND UNINTERRUPTED AVAILABILITY.

Some jurisdictions do not permit certain warranty exclusions. In that event, the exclusions apply only to the maximum extent permitted by applicable law.

21. Limitation of Liability for Site Use

TO THE FULLEST EXTENT PERMITTED BY LAW, LOS ALTOS NEUROLOGY AND ITS OWNERS, CLINICIANS, EMPLOYEES, CONTRACTORS, CONTRIBUTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, REVENUE, PROFITS, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO USE OF OR INABILITY TO USE THE SITE, RELIANCE ON PUBLIC SITE CONTENT, THIRD-PARTY LINKS OR SERVICES, UNAUTHORIZED ACCESS, OR INTERRUPTION OF THE SITE.

This limitation applies only to Site use and public Site content. It does not limit duties or liability arising from professional healthcare services and does not exclude or limit liability for fraud, willful misconduct or injury, violation of law, or any other liability or right that cannot lawfully be excluded or limited.

22. Indemnification for Unlawful Site Misuse

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Los Altos Neurology and its owners, clinicians, employees, contractors, contributors, and agents from third-party claims, losses, and reasonable costs to the extent arising from your unlawful misuse of the Site, your material breach of these Terms, or content you submit in violation of law or another person’s rights. This obligation does not apply to the extent a claim results from the Practice’s negligence, willful misconduct, violation of law, or other nonwaivable responsibility.

23. Changes to the Site or These Terms

We may update these Terms to reflect changes in the Site, our practices, or applicable requirements. The effective or last-reviewed date will be posted above. Changes apply prospectively when posted unless otherwise stated or required by law. When applicable law or a Site feature requires affirmative assent to a material change, we will seek that assent. Continued use after an effective change constitutes acknowledgment of the revised Terms to the extent permitted by law.

24. Governing Law and Forum

These Terms and disputes concerning use of the Site are governed by the laws of the State of California, without regard to conflict-of-law principles. Subject to any nonwaivable right to another forum, disputes concerning Site use shall be brought in the state courts located in Santa Clara County, California, or the federal court with jurisdiction over that county.

This section does not govern professional-negligence or other claims arising from healthcare services, which are governed by applicable law and any valid separate patient agreement. These Terms do not contain an agreement to arbitrate medical-malpractice claims.

25. Miscellaneous

If a provision is held unlawful or unenforceable, it will be enforced to the maximum lawful extent or severed, and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without written consent; the Practice may assign these Terms in connection with a lawful reorganization, merger, transfer, or succession of the Site or Practice.

These Terms, together with the policies incorporated above, constitute the entire agreement concerning public Site use. Headings are for convenience and do not limit interpretation.
